These terms and conditions of use govern you and ByteWave Networks respective rights and responsibilities relating to the use of the Internet at any Enabled Location (the “Terms and Conditions”). For the purposes of these Terms and Conditions and the preamble above, unless the context requires otherwise: “Acceptable Use Policy” or “AUP” means the policy setting out acceptable uses of the Internet and more fully described under “Undertakings in relation to “Acceptable Use Policy” below; “billing period” means the number of days for which a Internet Package purchased from ByteWave Networks Ltd
We collect personal information (name, email address, mobile number, location etc.) from you when you set up an account with us. We do use your contact information to send you offers based on your previous orders, interests and searches on our website. We automatically collect and store certain types of information about your use of internet services, including information about your interaction with content and services available through internet services.

Your account needs to be in ACTIVE status. Payment remainders with instruction on
how to pay will be sent to you 5 days before due date. Your account will be
suspended after due date if not payment is received. Reactivation of the account is
done by making payments.We shall not be liable for any inconvenience, loss,
liability, or damage resulting from any interruption of the Services, directly or
indirectly caused by, or proximately resulting from, any circumstances beyond our
control, including, but not limited to, causes attributable to you or your property
Billing period is 30 days.
You agree that ByteWave Networks may terminate this Agreement and cancel your access to the Internet with a 30 day notice and at any time for reason including, but not limited to, a violation of any of the Terms and Conditions, security or safety reasons, and/or using the Internet to perform any illegal activity. You further agree that in the event of termination for any reason, ByteWave Networks will have no liability to you. Refunds henceforth are or may/wil be initiated 30 day and maxof 60 day after Collection on gadgets The client can terminate the agreement at end of his or her account billing period. If termination takes place before account due date, no reimbursement will be done. The client may also terminate the agreement, and is subject to return gadgets / Equipments
Should the CUSTOMER default on payment for the service at any point, ByteWave Networks may disconnect the CUSTOMER immediately and recover devices installed at the customer’s premises at any point.All ByteWave Networks Equipment belongs to us, other third parties will not be deemed fixtures or in any way part of the Premises. ByteWave Networks Equipment includes all new or reconditioned equipment installed, provided or leased to you by us or our agents, including but not limited to, cabling and related electronic devices, cable modems, wireless gateway/routers, any other hardware and all software or “downloads” to ByteWave Networks Equipment. You agree to use ByteWave Networks Equipment only for the Services pursuant to this Agreement. We may remove or change the ByteWave Networks Equipment at our discretion at any time the Services are active or following the termination of your Service(s). You agree to allow us access to the Premises for these purposes. You may not sell, lease, abandon or give away the ByteWave Networks Equipment, or permit any other provider of video, high speed data or telephone services to use the ByteWave Networks Equipment. The ByteWave Networks Equipment may only be used in the Premises.
ByteWave Networks will take reasonable steps to ensure that the service is available to the CUSTOMER at all times, save that ByteWave Networks cannot guarantee a fault free service. Factors beyond ByteWave Networks, which may affect ByteWave Networks services, include but are not limited to acts of God, planned maintenance or rectification work, or equipment failure may interfere with the quality of the service.
Client sites are not restricted within ByteWave Networks range or reach. All services rendered by ByteWave Networks which includes installation is FREE the client is not to pay. In case a client may relocate he/ she should advise ByteWave Networks so as to attain its property back. Clients are not allowed to log into their router for security purposes. Moreover, ByteWave Networks does not restrict speed and usage of the internet by the client.
This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Kenya. Each party irrevocably agrees that the courts of the Republic of Kenya shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).
